Canada’s law on medical assistance in dying and mental illness remains one of the most closely watched questions in health law, and 2026 brought a significant development.
At present, people whose only medical condition is a mental illness are not eligible for medical assistance in dying (MAID). Under current law, that eligibility is scheduled to open on March 17, 2027.
On June 17, 2026, however, the Special Joint Committee on Medical Assistance in Dying released a report recommending that the government indefinitely exclude people whose sole underlying condition is a mental illness. The committee pointed to the difficulty of determining that a mental illness is irremediable, and to the challenge of distinguishing a request for MAID from suicidal intent. The federal government is expected to respond in late 2026 or early 2027.
